Seller

Pukkelpop - Thirty Merch (“the Seller”) has its registered office at Wetstraat 61 - 2060 Antwerpen and is registered with the Kruispuntbank der Ondernemingen (KBO) under number 823.603.343 . The VAT number is BE 0.823.603.343.

Applicability

By placing an order, the Buyer indicates acceptance of the following terms and conditions. These terms and conditions are an integral part of the contract as stipulated below, with the exception of any other general or special conditions stemming from the Buyer, unless there is an express written statement to the contrary.

Order acceptance

There is no legally binding contract until Thirty Merch has confirmed the order via email or has started the dispatching process.
All product information, prices and order information are subject to change and review at all times.

Delivery

Delivery can be made only after full payment has been received via the Pukkelpop website. Whenever possible, delivery of the goods will take place within the time frame mentioned in the order confirmation. Deliveries can only be made to the countries listed on the website.
Full responsibility for errors in the delivery address lies entirely with the Buyer. Errors in the delivery address may result in additional charges for the Buyer.
Unless stated otherwise, the prices listed do not include transport and delivery of the goods to the Buyer. Transport and delivery costs are listed separately.
The specified delivery times are merely an estimate and shall in no way be considered legally binding.
Delays in delivery do not entitle the Buyer to cancel the contract or demand compensation, except in the event of wilful delay.
Pukkelpop - Thirty Merch reserves the right to make partial deliveries.
In the event of non-delivery of the goods, any amount paid by the Buyer will be reimbursed without interest or any other form of compensation.

Reservation of ownership

All goods remain the property of Pukkelpop - Thirty Merch until payment is received in full, including all fees, charges and any interest due for late payment. Failure to pay will legally entitle Pukkelpop - Thirty Merch to reclaim the goods at the full expense of the Buyer.

Complaints

All complaints should be addressed to Pukkelpop - Thirty Merch: (a) in the event of incorrect delivery, within eight (8) days of delivery and (b) in the event of undisclosed faults, within eight (8) days after discovery of the fault, or within eight (8) days after the moment at which such a discovery is likely to be made. Receipt of the goods by the Buyer implies acceptance of any faulty or incorrect items which could be detected at the time.

Warranty

The warranty offered by Pukkelpop - Thirty Merch is limited to a guarantee against undisclosed faults and a consumer protection warranty, as stipulated by Belgian law.
Pukkelpop - Thirty Merch can only be held responsible for damage caused by gross negligence or wilful misconduct. Pukkelpop - Thirty Merch cannot be held liable for general or specific indirect losses of any kind suffered by the Buyer.

Events beyond our reasonable control

Pukkelpop - Thirty Merch will not be held responsible for any delay or failure to comply with our obligations if the delay or failure arises from any cause which is beyond our reasonable control. This includes supply difficulties or material shortages, interruption or permanent cancellation of production, strikes, lock-outs, any other forms of work stoppages or collective labour disputes, problems with energy or transport, transport delays affecting Pukkelpop - Thirty Merch and/or its suppliers, even if these events are foreseeable.
Failure to take immediate action if the Buyer has breached any of these conditions shall under no circumstances constitute a waiver of Pukkelpop - Thirty Merch’s rights to take action at a later date.

Personal information

By placing an order via the Pukkelpop website, the Buyer officially agrees to the use of its personal information for administrative purposes, which includes maintaining customer data, processing orders, billing, delivering goods and checking financial solvency. Personal information will not be used for promotional offers, personalized advertising and/or other marketing purposes, unless the Buyer expresses his/her explicit permission during the order process.
Pukkelpop - Thirty Merch does not share customer information with third parties. The Buyer reserves the right to review and correct his/her personal information at all times.
The Buyer is also entitled to object to the use of his/her personal information for direct marketing purposes without any additional charge. For more information the Buyer can contact the Privacy Protection Commission (Commissie voor Bescherming van de Persoonlijke Levenssfeer) in Brussels, Belgium.

Accepted evidence

In relation to their transactions, all parties agree to accept electronic documents as evidence.

Severability

If any part of these terms and conditions is deemed void, this will not affect the validity of the remaining provisions.

Applicable law

All contracts with Thirty Merch are governed by Belgian law. The competent court in the city of Hasselt has exclusive jurisdiction.

3. FAQ

• Can I collect my order on-site at the Pukkelpop festival?

  This is not possible. However, there is a merchandise stall at the festival site.

• What happens if I am not home at the time of delivery?

  It is also possible to have your order delivered to your workplace. If you are not home when delivery is attempted, the parcel will be delivered to a local parcel depot. For more information go to the website of the delivery company:

• What is 3D Secure Payment?

  3D Secure functions as the device used to read your debit or credit card. It is an added layer of security recommended by card issuing companies.

• What is the estimated delivery time?

  All orders for Belgian destinations are shipped within three working days.
